Terms and conditions of Mitico online sales service

1.1 - Before proceeding with the order, please read the terms and conditions of our online sales service carefully. These are the terms you will accept at the time of confirmation of each new order.
1.2 - 
Acceptance of these terms is mandatory in order to continue to finalize each new order.
1.3 - 
The term "working days" in this document refers to days from Monday to Friday. Saturday and Sunday are not considered working days.


2.1 - "Website" means the website accessible at www.miticosugarart.it or any linked URL, provided that it is headed and managed by Mitico di Raggi Chiara & C. S.n.c .; "Mitico" and "We" indicate the legal domicile of Mitico di Raggi Chiara & C. S.n.c .: Piazza dei Consoli 44-45, 00175 Rome, IT; "Conditions" refers to this document; "Product" means a product for sale on the website; "Product Sheet" means the part of the website that specifies the specific information of a particular product; "Price" is the selling price indicated for a product; "Users" refers to the users of the website as a whole; "Personal Information" means all details provided by the user at registration; "Confirmation E-Mail" is the email message that we automatically send with the order summary; "Italy or IT" means Italy as a whole; "You", "User" means the user of the website.

3.Access to the Website

3.1 - When finalizing any new order on the website, you will be mandated to accept the Terms and Conditions of the online sales service and each new order will be deemed to be binding on the accepted rules from time to time. We are constantly working to provide a service with no interruptions or errors. However, given the nature of the Internet, we can not guarantee it. In some circumstances we may temporarily suspend or restrict access to the web site for periodic or extraordinary maintenance, or to add new features.

4.Access from outside Italy

4.1 - Most of our users are located in Italy but we are able to offer our products and services also in Europe. The User is responsible for checking the regulations in force in his country and their applicability. The complete list of European countries covered by the shipping service can be reached and downloaded at the link in the paragraph "9.Shipments".


5.1 - The user is legally responsible for the accuracy of the personal data provided during the registration process at the website. Personal data must be real, accurate, up-to-date and complete. In the event of a change, the user commits to modify his own data by his personal account or by notifying us in an instant via email or telephone to our contacts available in the Customer Service section or at the bottom of the website Home Page, so that we can make timely changes to your account's identifyng history.

6.Account Security

6.1 - The user agree to keep their access credentials private (E-Mail Address and Password). The user is  legally responsible for any activity generated by his account.
6.2 - We will not be liable for any direct or indirect loss if user fails to keep his access credentials private.

7.Contractual conditions

When the user sends a purchase order, he automatically receives a confirmation email (order confirmation E-Mail). The order has the legal tender status of user's purchase. As soon as the user completes the order (order confirmation STEP 5), the purchase offer may be considered confirmed.

8.2 - Mitico di Raggi Chiara & C. S.n.c. is a business with registered office in Piazza dei Consoli, 44-45, 00175 Rome, registered regularly in Italy at the Registry of Companies of the Chamber of Commerce of Rome with REA number RM-1270632, VAT number 10998571003 and Tax Code 10998571003.


9.1 - Our goal is to ship in as short a time as possible. For our shipments we rely on


9.2 - The shipping service is divided into three types, two for deliveries in Italy and one for shipments to Europe:

  • Poste Italiane SDA Crono Standard - delivery in 3/4 working days in Italy starting from the day following the departure of the ordered goods (from Monday to Friday).
  • Poste Italiane SDA Crono Express - delivery in 1/2 working days in Italy starting from the day following the departure of the ordered goods (from Monday to Friday).
  • Poste Italiane SDA Crono International - delivery in 10/15 working days starting from the day following the departure of the ordered goods (due to COVID-19) in Europe (from Monday to Friday)

For all shipping methods listed, on delivery times should not be considered the day of departure of the shipment or days prior to that of departure (times and locations are provided by Poste Italiane).
9.3 - The
costs of each shipping service listed above are calculated based on the total weight of the products included in the purchase order; the specific rates for each weight range as well as the European countries covered by the shipping service can be reached and downloaded from the following links:

9.4 - The Mitico online sales service as regards shipments to Italy does not allow you to request delivery on a specific day or time of the day while there are two delivery attempts in total; in case of recipient absent on both, the shipment can then be collected at the nearest post office where it will remain in free storage for 10 days. If the user wishes, he can use the notifications that will be left by the courier in the mailbox and contact Poste Italiane directly and reschedule the delivery by providing the tracking number, choosing between one of the two services listed below

- CONSEGNA AL VICINO service: in the event of an absent recipient, the shipment can be delivered to another recipient located at the same address as the main recipient;

- SCEGLI TU service: possibility for recipients to have delivery on another date, to another address, at a post office or post office.

If no alternative service is chosen by the user from those listed above or the 10 days of free storage of the shipment end, the same will be returned by Poste Italiane SDA directly to the sender and if the user wishes to receive the shipment again he will be forced to bear the initial shipping costs a second time.

9.5 - The Poste Italiane SDA Crono service provides accessory insurance for shipments upon payment of an additional fee to the shipping cost by the user; once the order has been confirmed, it will be possible to request shipping insurance via e-mail at mitico.online@live.it but only as long as the status of the order is on "Preparation in progress"; when the status has changed to "Delivery in progress", it will mean that the order has been taken over by the express courier, therefore, it will no longer be possible to request insured shipping (the various order states may be displayed by the received e-mails or by viewing the status of the order within your account).

Once we have received a request from the user via email to insure the shipment, we will immediately calculate the surcharge that we will communicate by e-mail directly to the address used by the user during registration.

No orders will be dispatched before receipt of payment for insured shipping; the payment method for the balance of the surcharge can be easily decided by the user according to his needs, choosing from the standard payment methods accepted by our online sales service.

9.6 - In accordance with current legislation (Article 63 of Legislative Decree 206/200) in the case of uninsured shipments, the risk of damage and deterioration of goods is always borne by the merchant during shipment and transport, and is transferred to the Consumer only when the latter - or a third party designated by him and other than the carrier - is physically in possession of goods. That's why we use traceable shipments for our customers.
9.7 - In the event that the carrier 
has been chosen by the Consumer outside of the ones proposed at the time of purchase, the risk of damage to and deterioration of the goods is transferred to him at the time of delivery to the carrier itself, excluding any disputes concerning to the external features of the delivered. In this case, each contestation must be moved directly by the Consumer to the carrier.
9.8 - 
Shipping costs will be free for purchases from Italy over €75.00; will be automatically deducted at the time of the purchase procedure if the amount of the expenditure exceeds the above figure.


10.1 - The total amount of the order is charged immediately after the completion of the purchase procedure on the site by e-mail (order confirmation e-mail); no orders will be shipped before payment is received. In case of problems with the payment, you will be contacted immediately by Customer Service.
10.2 - If no payment is received within 5 working days from the order confirmation date, the same will be automatically canceled and you will receive an email confirming the cancellation.
10.3 - The payment methods currently used by our online sales service are: Bank transfer, PayPal and Withdrawal and payment in shop.
10.4 - In the case of choice of bank transfer as payment method, the bank details will be provided to the user on the page following the order confirmation and also by e-mail to the address left during registration.
10.5 - The method for possible refunds can be easily decided by the user according to his/her needs by emailing us at address mitico.online@live.it. 

11.Rules of pick up and payment in store

11.1 - Pick up and payment in store is a service that allows the user to book their merchandise on the website by making a classic order by inserting the various products into the shopping cart; when checking out, choosing the payment method you will have to choose the option "Pick up and payment in store" and confirm the order in the next step. Once confirmed, the user will receive the classic mail summary.
11.2 - We will reserve a 24-hour time to prepare the merchandise to be withdrawn at the store.
11.3 - As a result, it will not be possible to pick up the ordered products on the day of ordering.
11.4 - As soon as the order is ready for pick up, you will receive a new email confirming that the merchandise is ready to be withdrawn.
11.5 - It will be possible to pick up your order within and not later than 48 hours after the mail confirming that the goods are ready for pick up; once this deadline expires, the order will be canceled and the reserved products will automatically be returned for sale.
11.6 - In the event of cancellation of the order for the above mentioned reason, you will receive an email confirming the cancellation of the order.

12.Products, descriptions and prices

12.1 - We are constantly working to meet requests of our users, but we can not guarantee uninterrupted availability of all items in stock.
12.2 - The word "Gold" and "Silver" refers to the color of some products and does not in any way indicate the presence of precious materials.
12.3 - We pay particular attention to the descriptions of the products and their accuracy. In some cases the images used to represent the products may differ from the original packaging. Weights, dimensions, capacity and manufacturer indicated are to be considered real.
12.4 - We offer a wide range of edible and non-edible coloring, so we understand the importance of correct gradation. We have used every means to show on our website an accurate color representation. However, since the colors displayed depend on many factors such as ambient lighting, brand and monitor model, screen settings, etc., we can not guarantee that the colors shown correspond exactly to the actual colors of the products.
12.5 - The prices of some products on our site may be deducted from those present at the store, subject to certain product discounts reserved exclusively for online sale.

13.1 - We recommend caution in the use of non-edible products on cakes or other edible products and disclaim any liability arising from inappropriate use of the products.
13.2 - For proper information correctness, we also pay special attention to the gluten-free products in our catalog; such products may be recognizable through the symbol on the product page 


14.1 - For orders containing:
   14.1.1 - Articles such as various equipment with blades or pointed. By submitting the order, user confirms to be over 18 years of age.
   14.1.2 - Articles containing alcohol. By submitting the order, user confirms to be over 18 years of age.

15.Right of withdrawal in accordance with Dlgs 206/2005 mod. D.Lgs. 21/2014

15.1 - The user has the right to withdraw from the purchase agreement, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day the goods were received.                                             
15.2 - In order to exercise right of withdrawal, user is required to inform us of his decision to terminate this contract by an explicit statement, such as a letter sent by mail or e-mail (Mail: Mitico di Raggi Chiara & C. S.n.c., Piazza dei Consoli, 44-45, 00175 Rome, e-mail: mitico.online@live.it). To this end is possible 
to use the withdrawal form model available by clicking on the link in brackets
(Recess Module).                                               
15.3 - To comply with the term of withdrawalit's enough to send the communication regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.                                                                      
15.4 - The shipping costs of the withdrawal within the terms set forth, will be borne by the user; If for the user is congenial, he/she can return the goods purchased, hand and free at the point of sale Mitico, located in Piazza dei Consoli 44-46, 00175 Rome.
15.5 - In case the total or partial withdrawal of the products purchased was motivated by a delay in the shipment (only in case of posting it over the seventh working day from the date of order), Mitico di Raggi Chiara & C. S.n.c. will support the shipping costs related to the withdrawal.

16.Regulation of goods return and withdrawal effects

16.1 - If the user withdraws from the purchase agreement, he will refund all payments made on our behalf, including delivery costs (except for the additional costs resulting from your choice of a delivery type other than the least expensive delivery type standard we have offered), without undue delay and in any case not later than 14 days from the day we are informed of your decision to terminate this contract. Refunds may be withheld for more than 14 days only until you have proven to have returned the goods or until these have been received by us, whichever occurs first.
16.2 - These refunds will be made using the same method of payment you have used for the initial transaction, unless you have agreed otherwise; in any case, you will not have to bear any cost as a consequence of such refund.
16.3 - In accordance with current legislation (Art. 55 Consumption Code), it is not possible to exercise the right of return on food products or jewelery items, even if sealed. The only exceptions are defective non-food products or food products beyond the expiration date.

16.4 - In both return and replacement cases, the direct cost of returning the goods will be borne by the consumer, even if the return was motivated by the refusal of a replacement. The cost is estimated between a minimum of €7.50 to a maximum of €19.90 for shipments to Italy and a minimum of €16.50 to a maximum of €112.00 for those to european countries covered by the shipping service. . The specific rates for each weight range as well as the european countries covered by the shipping service can be reached and downloaded from the links in paragraph "9. Shipments ".
16.5 - In cases of the delivery and/or replacement of food products beyond the expiry date, Mitico di Raggi Chiara & C. S.n.c. will support shipping costs.
16.6 - Non-food goods returned must be returned to us within 14 solar days from the day the user has expressed the will to return. The returned goods must be intact and must be returned with original packaging and accessories.
16.7 - The user is responsible only for the diminution of the value of the goods resulting from manipulation of the goods other than the one necessary to establish the nature, characteristics and operation of the goods.
16.8 - The consumer is obliged to return the goods subject to return full and complete, so that they will not be damaged during shipment. If the items were damaged or lost during transportation, or if they were sent at the expense of the recipient, Mitico di Raggi Chiara & C. S.n.c. will charge the costs to the user.
16.9 - The consumer is required to return the non-food items that are the subject of the delivery or to deliver it to us without undue delay and in any case within 14 days from the date on which he has notified us of his withdrawal from this contract. The term is respected if the consumer returns the goods before the expiration of the 14-day period (the goods being returned will be returned to Mitico di Raggi Chiara & C.S.n.c.,Piazza dei Consoli, 44-45, 00175 Rome).

17.Exclusions from withdrawal

17.1 - The right of withdrawal is excluded in the following cases provided by art.59 of the Consumption Code:

a) service contracts after full service provision if execution is commenced with the express agreement of the consumer and with acceptance of the loss of the right of withdrawal as a result of the full performance of the contract by the professional;
b) the supply of goods or services whose price is linked to fluctuations in the financial market that the professional is unable to control and may occur during the withdrawal period;
c) the supply of custom-made or clearly customized goods;
d) the supply of goods that are likely to deteriorate or expire rapidly;
e) the supply of sealed goods that can not be returned for hygienic reasons or are related to health protection and were opened after delivery;
f) the supply of goods which, after their delivery, are, by their nature, inseparably blended with other goods;
g) the supply of alcoholic beverages, the price of which has been agreed at the time of the conclusion of the sales contract, the delivery of which can take place only after thirty days and whose actual value depends on fluctuations on the market that can not be controlled by the professional;
h) contracts where the consumer specifically requested a visit by a professional for the purpose of performing urgent repair or maintenance work. If, during such a visit, the professional provides services other than those specifically required by the consumer or goods other than the spare parts needed to carry out maintenance or repairs, the right of withdrawal applies to such services or additional goods;
i) the provision of sealed audio or video recordings or sealed computer software that was opened after delivery;
j) the supply of newspapers, periodic and magazines apart from the agreements of subscription for the supply of such publications;
k) contracts concluded at a public auction;
l) the provision of non-residential housing, carriage of goods, car hire services, catering services or leisure time services where the contract provides a specific date or period of execution;
m) the supply of digital content by means of non-material support if the execution is commenced with the express agreement of the consumer and with his acceptance that in that case he would lose the right of withdrawal.

18.Privacy and security

18.1 - Personal data is private and therefore treated with the highest security and confidentiality standards. We do not disclose the data of our users for marketing purposes to companies outside Mitico di Raggi Chiara & C. S.n.c. We maintain the user's data to process orders and keep the account active on the website.
18.2 - The user has the right to consult, update, rectify or integrate the data recorded on the website. You also have the right to request the cancellation of the whole account and all the master data contained therein by e-mail at mitico.online@live.it.
18.3 - To ensure maximum protection for our customers, we will confirm that we will not receive any details regarding your payment method. All data passes encrypted.

19.Settlement of disputes

19.1 - Mitico di Raggi Chiara & C. S.n.c. society  inform the user of the consumer qualification referred to in art. 3, paragraph 1, lett. a) of the Consumer Code, which established a European platform for online dispute resolution of consumers (c.d. ODR platform). The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/;
19.2 - Through the ODR platform, the consumer user will be able to consult the list of ADR organisms, find the link to each of them website and initiate an on-line dispute resolution procedure in which he is involved.

20.Legal compliance of goods conformity

20.1 - The products purchased on the online sales web site www.miticosugarart.com are covered by the legal warranty of goods compliance, artt.128 and ss. Consumption Code.
20.2 - The legal warranty is valid for two years and must be claimed by the consumer within two months of the defective discovery.

21.Changes to Terms and Conditions

21.1 - We reserve the right to periodically modify these terms and conditions of online sale; the user has the right to check them at any time and should check them before making an order.
